FCA Brings Offshore Crypto Platforms Under UK Rules

Overseas exchanges, custodians and staking providers must map UK consumer access before the 2027 regime, with authorization depending on each service’s structure.

The UK Financial Conduct Authority says overseas crypto providers can fall within the country’s incoming authorization regime when they serve British consumers, even if they are established abroad. The FCA published its final cryptoasset perimeter guidance on Sept. 16, ahead of an application window opening Sept. 30, 2026. The new regulated activities enter the perimeter on Oct. 25, 2027.

Why it matters

The guidance defines a UK consumer as an individual in the UK acting outside a trade, business or profession. That statutory territorial concept can differ from client categories elsewhere in the FCA Handbook, making consumer access a central compliance question for offshore platforms, custodians and staking providers.

For overseas trading platforms, the outcome depends partly on how an authorized UK firm interacts with the platform. A platform unavailable to UK consumers can remain outside the platform activity perimeter when the UK firm trades on it as principal. The overseas operator can fall inside the perimeter when the UK firm accesses it as agent for UK consumers.

Market impact

Overseas providers safeguarding cryptoassets or arranging staking for UK consumers can also be deemed to operate in the UK when they act independently of an authorized person. Acting at that person’s direction can place the arrangement outside the relevant deeming provision. Automated-protocol interfaces require case-specific analysis based on whether an identifiable person carries on regulated activity by way of business in the UK.

Transitional applications run from Sept. 30, 2026 through Feb. 28, 2027. Existing registrations and permissions will not convert automatically, so firms may need to vary their permissions when their current scope omits the new activities. The guidance is not binding in court, leaving each exchange, custodian, staking service and DeFi interface to assess its own structure.
