Kalshi permanently banned former U.S. Rep. George Santos from its platform on Monday, the first lifetime suspension the federally regulated prediction market has ever issued. The Notice of Settlement of Disciplinary Action found Santos violated Kalshi's rules by trading a contract on whether he would attend the State of the Union, and ordered him to pay a fine of just over $71,000.

The Kalshi Compliance Department said it established reasonable cause to believe Santos traded markets tied to his own attendance at the address, the exact conduct the CFTC flagged in a separate settlement last month. That earlier settlement ordered Santos to pay $35,000 to resolve claims that his public statements two weeks before the speech caused the contract price to move significantly. He did not admit or deny the CFTC's findings. His counsel, Joseph W. Murray, said at the time that Santos cooperated and noted the SOTU was Santos's first-ever prediction-market trade, and that he had booked flights to D.C. believing he was attending.

Santos represented New York's 3rd district from January 2023 until his expulsion later that year following a House Ethics Committee investigation into ethics violations.

Why it matters

Prediction-market insider trading is now a live enforcement category, not a theoretical one. Within weeks, Kalshi, the CFTC, and the Justice Department have all moved on the issue from different angles. The CFTC ordered former White House teleprompter operator Gabriel Perez to pay more than $172,000 on Friday for using advance access to President Trump's speeches to trade Kalshi mention markets. In April, the DOJ arrested an active-duty U.S. Army soldier for trading Polymarket ahead of former Venezuelan President Nicolás Maduro's capture. Bipartisan bills to restrict trades by people with non-public information have been introduced in Congress but not passed.

Market impact

The total dollar cost to Santos is roughly $106,000 across both actions, but the lifetime platform ban is the structurally heavier outcome.
